Activists against Aleco arrested in Albay

The recent controversy involving the takeover of Albay Electric Cooperative (Aleco) resulted in the arrest of four activists this morning.

The issue started during the from the Aleco Multi-Sectoral Stakeholders Coalition (AMSSO) which was participated in by AMSSO head Lawyer Bartolome Rayco, Karapatan Bicol Spokesperson Vince Casilihan, Kilusang Mayo Uno (KMU) spokesperson Hernan Certeza, and Kabataan Partylist member Carl Gana.

Complaints for malicious mischief and grave coercion were filed against them, for alleged forced entry  into the electric cooperative's building at around 10 o'clock in the morning.

Legazpi City PNP chief Police Supt Rommel Dela Rama himself led the arrest.

It will be recalled that the group had long interposed their vehement objection against the privatization of said distribution facilility.

In a statement which was publised in BICOL STANDARD last month, Casilihan criticized what he called "deceitful maneuvers that shove the people’s electric cooperatives against the wall in order to force them into privatization."

He added: "With insatiable greed, these monsters are not content with passing on generation, transmission, systems loss charges and other unjust payments.” "Thanks to the government’s neglect, even public distribution units like ALECO and CASURECO are prey to sharks.”

Earlier today, Casilihan also posted on his Facebook account the following statement:

The PNP slogan, “to serve and protect” is a mockery

Karapatan-Bicol condemns in the strongest terms possible the warrantless and illegal arrest of Paul Vincent Casilihan, Karapatan-Bicol Spokesperson, Atty. Bart Rayco, Chairman of ALECO multi-sectoral Stakeholders’ Organization (AMSSO) and a member of National Union of People’s Lawyers (NUPL-Bicol), Hernan Certeza of KMU-Bicol, and Karl Anthony Canata of Youth Act Now at around 1:45 PM of February 24, 2014 by more or less thirty (30) PNP elements on order of P/Supt. Rommel De La Rama, Legazpi City PNP Chief of Police.

The arrest was made while Albay Electric Cooperative (ALECO) member-consumers and the multi-sectoral groups were inside ALECO compound protesting the continued presence of San Miguel Corporation Global Power Holdings, Inc., a concessionaire for ALECO’s operations and management whose concession contract with the old ALECO Interim Board of Directors was deceitful and invalid; and to invoke, defend and protect the member-consumers’ collective rights and interest as the real owners of the electric cooperative.

The arresting officers committed blatant violations of the rights of those arrested. At the time of arrest the arresting officers did not properly and formally informed the victims of the alleged crime imputed to them, neither were they informed of their rights under the Miranda doctrine.

Moreover, the arresting officers manhandled Hernan Certeza and Karl Anthony Canata. The two sustained bruises in some parts of their bodies. Atty. Madonna Gay Escio, who came for quick response to the arrest was shoved by arresting officers and complains of pains at her left arm.

The highhandedness in the conduct of arrest and the brutality demonstrated by the arresting officers only shows the fascist character of PNP elements. Such a display of force and arrogance by uniformed state security forces against unarmed civilians peacefully exercising their democratic rights clearly proves that their respect for human rights is nothing but mere lip service.

For several hours after the arrest, the victims were held at the PNP Legazpi headquarters without formal charges yet. They were made to wait for the inquest fiscal to come. No effort was made by the PNP Legazpi to facilitate the conduct of the necessary inquest.

Karl Anthony, a 17 years old student was brought by the PNP elements to the City Social Welfare and Development (CSWD) of Legazpi City. When friends and the grandmother of Karl inquired of him in this office, those in the CSWD vehemently denied having him in their custody. But when pressed further, they said they were told by PNP Legazpi not to confirm having custody of the student should somebody inquire about him. The conspiracy by these two public institutions in withholding information is very deplorable.

Karapatan-Bicol denounces the lies and half truth weaved by Albay Power Energy Corporation (APEC), the entity that manages ALECO for San Miguel Corporation Global Power Holdings, Inc., which the PNP Legazpi used in filing the trumped-up cases against the four victims of illegal arrest.

It is very appalling that the incident of illegal arrest happened in the occasion of the 29th anniversary of EDSA people power. The fascism of martial law years is very much alive even today in the State security forces.

Albay governor Salceda, other officials, siding with San Miguel Energy than consumers – says online poll survey

LEGAZPI CITY, Albay, 21Feb2014 (BicolToday.com) – Majority of Albayanos believe Governor Joey Salceda and other Albay officials protect the business interests of San Miguel Energy Corporation than the interests of power consumers, while only a minority think the officials are siding with the consumers.

A poll survey conducted by online BicolToday.com last month, until its cut-off date Thursday, February 20, this year, 66.36% of Albayanos think Governor Salceda and other officials are siding with SMEC, while 33.64% believe the officials are protecting the consumers’ interests.

The online poll survey asks: “Do you believe that Governor Salceda and other Albay officials are protecting the interests of San Miguel Energy, and not the interest of consumers?”

Over the past months, Albay power consumer groups, spearheaded by cause-oriented organizations mounted series of protest actions in opposing the planned take-over by SMEC over the bankrupt Albay Electric Cooperative (ALECO).

During the series of protest activities, Governor Salceda and other officials had become bench-warmers, while the burden of protests was carried by cause-oriented groups in collaboration with other consumer groups.

ALECO was over-burdened by huge debts due to mis-management and questionable anomalous transactions, and according to planners for its recovery, privatization or takeover by another power company may bring back the firm to viability.

SMEC won in the bidding for its privatization, but its planned take-over was strongly opposed by consumer activist groups.

Many Albay power consumers believed they have equity over the power sector as a national/provincial resource, on the reason that geo-thermal energy, which supply a significant portion of the total power demand in Luzon, is generated from the province’s backyard in Tiwi town.

On why Albayanos believed Governor Salceda and other officials are siding with SMEC are subject for speculations.

There were rumors that SMEC has put up a lobby fund to ensure “smooth takeover by SMEC of ALECO, and that to make sure that there will be no resistance or opposition.”

The lobby fund is grease or bribe money. Aside from the lobby fund, favored politicians had received project-support assistance from private foundations which have links with SMEC.

There were also unverified reports that SMEC gave big contributions to favored politicians during the 2013 elections, a political investment with a pay-back, its end-goal is the most sought- after control of ALECO.

According to sources, SMEC’s control of ALECO means unhampered exploration and control over Albay’s other geo-thermal fields which are still not open for new exploration franchises outside of the Philippine Geothermal franchise area. PAUL VINCENT

Always obedient and helpful, his name is "Calpot" to his loved ones. He is a good brother to Janno. He can be depended on any task or undertaking assigned by his parents. He learned to be independent at an early age.Very studious and a voracious reader. He acquired an encyclopedia as a request from his parents which he studied continuously until he was dubbed by his friends as a walking encyclopedia. Paul Vincent started his early education in Abano Pilot School in Daet. Then, he finished his elementary school in North Central School in Sipocot, Camarines Sur. He finished his high school in Villazar National High School in Sipocot. Always an honor student and very active in school activities. He was a student leader and a staff member of their school organ. He also represented his school in many sports competitions in Table Tennis and Lawn Tennis, especially in the Bicol Meet. He is truly a sportsman at heart.

Paul Vincent came from a landed family from Sipocot. They have a 6 door apartment in Daet and their lands are planted commercially with Calamansi, mangos, rice, coconuts, mandarin, coffee etc. Such amenities and comforts are common in his life. But things got mixed up when he learned the socio-economic life of the people. The inequality of the rich and poor. His calling to serve the poor is greater than to live the comforts of life. He studied in Ateneo de Naga and learned many issues that deprived the people. His activism brought him to foster and developed his association with Human Rights. So many people are oppressed and harassed. His help and care for these people can be attested by many, looking for hope and solutions. Vince is no ordinary and can be a hero to everyone of us.
